Terms and Conditions for Vendor Listing on Remaininthegame.ca
These terms and conditions (“Terms”) constitute a legally binding agreement between Remaininthegame.ca (“we”, “us”, or “our”) and any vendor (“Vendor”, “you”, or “your”) wishing to list their products on Remaininthegame.ca. By listing your products on Remaininthegame.ca, you agree to be bound by these Terms.
1. Listing Approval:
a. We reserve the right to approve or reject any product listing at our sole discretion.
b. Approval of a product listing does not constitute endorsement or guarantee of the product’s quality or performance.
2. Product Information:
a. You are responsible for providing accurate and up-to-date information about your products, including descriptions, pricing, and images.
b. You agree to promptly update any changes to your product information to ensure accuracy.
3. Product Compliance:
a. You warrant that all products listed comply with applicable laws, regulations, and industry standards.
b. You agree to indemnify and hold harmless Remaininthegame.ca against any claims, damages, or liabilities arising from non-compliance with laws or regulations.
4. Pricing and Payment:
a. You have the sole responsibility for setting the prices of your products.
b. Remaininthegame.ca may charge a commission or fee for each sale made through the platform. Details of any such fees will be provided separately.
5. Order Fulfillment:
a. You are responsible for fulfilling orders promptly and accurately.
b. You agree to notify Remaininthegame.ca of any delays or issues with order fulfillment.
6. Intellectual Property:
a. You retain all rights to your intellectual property associated with your products.
b. By listing your products on Remaininthegame.ca, you grant Remaininthegame.ca a non-exclusive license to use your intellectual property for the purpose of promoting and selling your products.
7. Termination:
a. Either party may terminate this agreement at any time with written notice.
b. Upon termination, you agree to promptly remove your product listings from Remaininthegame.ca.
8. Limitation of Liability:
a. [Third Party Website] shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.
b. In no event shall Remaininthegame.ca’s total liability exceed the total amount paid by you to Remaininthegame.ca in the preceding six months.
9. Governing Law:
These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada without regard to its conflict of law principles.
By listing your products on Remaininthegame.ca, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not list your products on Remaininthegame.ca.
These Terms may be updated or modified by Remaininthegame.ca from time to time. It is your responsibility to review these Terms periodically for any changes. Your continued use of Remaininthegame.ca after any such modifications shall constitute your acceptance of the modified Terms.
